2. Premise and application

These Terms and Conditions govern the use of the website labaiadeisogni.it/en/ and the booking of stays at the "La Baia Dei Sogni" holiday rental property in Tropea (VV), Italy.

By making a booking, the user fully accepts these Terms, the Cancellation Policy and the Privacy Policy.

3. Services offered

The property offers vacation apartment rental with the following features:

• 6 apartments: Turchese, Conchiglia, Stella Marina, Corallo, Perla, Baia
• Minimum and maximum stay as confirmed at the time of booking
• Final cleaning included
• Bed linen and towels included
• Utilities (water, electricity, gas,) included
• Parking space subject to availability
• Air conditioning
• Equipped kitchen

4. Booking and payment

4.1 How to book

4.2 Payment

Payment is processed through Stripe (stripe.com), a secure PCI-DSS Level 1 certified payment provider. Major credit and debit cards are accepted (Visa, Mastercard, American Express).

Payment is made at the time of booking confirmation.

The invoice/receipt is sent via email after payment.

5. Prices and taxes

Prices are in Euro (€) and include 10% VAT for tourist stays as per Italian regulations.

Prices EXCLUDE:

• Municipal tourist tax (where applicable by Tropea municipality): typically € 1-2 per person per night, payable on site
• Security deposit (where required): to be agreed
• Extra services (transfers, excursions, extra cleaning, etc.)

6. Check-in and check-out

• Check-in: from 3:00 PM to 8:00 PM on arrival day
• Check-out: by 10:00 AM on departure day
• Off-hours check-in: to be agreed in advance (may incur a surcharge)
• ID document required at check-in for guest registration (legal obligation)

7. House rules

• No smoking inside the apartments
• Pets allowed
• Quiet hours: 11:00 PM to 8:00 AM
• Maximum number of guests as per booking (undeclared guests not allowed)
• No events/parties allowed
• Check-out by 10:00 AM (late check-out = surcharge)

8. Cancellation Policy

8.1 How to request cancellation

Cancellation must be requested by email to labaiadeisogni26@gmail.com with subject "Cancellation booking [number]".

The date of email receipt is used to calculate the 7-day period.

8.2 Refund method (Stripe)

Refunds are processed through Stripe on the same payment method used for the booking.

Processing time: the refund is initiated within 7 business days from email confirmation of cancellation. Funds are credited to the customer's card within 5-10 business days thereafter, depending on the issuing bank.

Fees: Stripe does not charge fees on full refunds. Original payment processing fees are not refunded (where applicable, per Stripe Terms).

Currency: the refund is made in the same currency as the original transaction (Euro).

8.3 Exceptional cases

In case of:

• Force majeure (natural disasters, health emergencies, war)
• Travel restrictions imposed by authorities
• Serious documented illness of the customer or close family members

The standard cancellation policy may be waived on a case-by-case basis, at the sole discretion of the host.

9. Privacy Policy (GDPR)

9.1 Data Controller

9.2 Data collected

• Contact data: name, surname, email, phone
• Payment data: managed by Stripe (we only see the last 4 digits)
• Check-in/check-out dates and number of guests
• Communications between you and us (email, phone)

9.3 Purpose of processing

• Booking and stay management
• Legal and tax obligations (guest register, invoicing — 10-year retention)
• Communications related to the stay
• Marketing communications only with explicit consent

9.4 Legal basis

Contract execution (booking), legal obligations, consent for marketing communications.

9.5 Retention

Personal data is retained for 10 years from end of stay (tax obligations).

9.6 Data subject rights (GDPR art. 15-22)

The user has the right to:

• Access to their data (art. 15)
• Rectification (art. 16)
• Erasure/right to be forgotten (art. 17)
• Restriction of processing (art. 18)

9.7 Cookies

10. Limitations of liability

The host is not responsible for:

• Events caused by force majeure
• Disruptions due to urgent extraordinary maintenance
• Theft or damage caused by third parties
• Unforeseeable interruptions of public services (water, electricity, internet)

11. Complaints and jurisdiction

For any complaint, the user can contact the host at labaiadeisogni26@gmail.com.

For disputes not amicably resolved, court of jurisdiction: Court of Vibo Valentia.

12. Modifications to the Terms

The host reserves the right to modify these Terms with at least 30 days notice. Modifications do not apply to already confirmed bookings.

13. Applicable law

These Terms are governed by Italian law. For contracts concluded with consumers, Regulation (EC) No 593/2008 (Rome I) also applies.
